Terms of Service

Simple, fair, and transparent rules for our global anonymous community. No legalese, just respect and clarity.

1. Acceptance of Terms

By accessing or using Funtoosh website, progressive web app, and related services (collectively, the “Platform”), you agree to these Terms of Service, Privacy Policy, and other policies referenced herein. If you do not agree, please do not use the Platform. Funtoosh is operated by Funtoosh Private Technologies Private Limited.

2. Definitions

  • Anonymous Messaging: Communication where sender and receiver are identified only by pseudonymous usernames, without phone number requirement.
  • Email OTP Login: Authentication via one-time password sent to email, valid 5 minutes, single-use.
  • User Wallet: Internal ledger for wallet recharge, paid messaging, tips, and premium features.
  • User Profiles: Pseudonymous profiles with display name, bio, and discovery preferences.
  • Paid Messaging: Optional monetized messages where creator sets price for DM access.

3. Eligibility

  • You must be at least 18 years old to create an account. Under India's DPDP Act 2023 everyone under 18 is a "Child", and Funtoosh does not knowingly create or operate accounts for children.
  • You must comply with local laws regarding anonymous communication and financial transactions.
  • One person may maintain one primary account; up to 2 additional personas are permitted for privacy, provided they are not used to evade blocks or bans.
  • Business accounts must provide accurate business information where wallet payouts are involved.

4. Accounts & Anonymity

4.1 Registration

Sign-up requires Full Name and Email Address. Email is verified via OTP. Full Name is used for display and wallet compliance where applicable; you may use a pseudonym consistent with community standards, but wallet payouts above regulatory thresholds require accurate information.

4.2 Anonymity Responsibility

  • Your username is your public identity; keep private information private if you wish to remain anonymous.
  • Do not attempt to de-anonymize others via IP grabbing, social engineering, or unauthorized data aggregation — results in immediate suspension per Account Suspension Policy.
  • Keep your email secure; OTP is single-use, time-limited, and rate-limited.

5. Acceptable Conduct

To maintain a safe environment for anonymous communication, you agree not to:

  • Harass, threaten, dox, stalk, or incite violence or self-harm
  • Share Child Sexual Abuse Material, non-consensual intimate imagery, or sexual content involving minors — zero tolerance, immediate ban and legal report
  • Distribute spam, scams, phishing, malware, crypto drainers, or engage in fraud
  • Impersonate Funtoosh staff, use official badges without authorization, or create deceptive profiles
  • Attempt to reverse engineer, scrape at scale, disrupt edge network, or bypass security monitoring
  • Buy, sell, or trade accounts or wallet balances

We employ content moderation for reported content, automated spam and abuse filters over content and metadata, and human review before account-level action. Funtoosh is not end-to-end encrypted.

6. Content & Ownership

6.1 Your Content

You retain ownership of messages, media, and profile content you create. By sending, you grant recipient a non-exclusive license to view. For discovery or promotional purposes, you grant Funtoosh a limited license to display your public profile (username, bio, avatar) where you opt-in to discovery.

6.2 Platform Content

Landing page, branding, UI, and advertisements are owned by Funtoosh. Do not copy or reproduce without permission per Intellectual Property Policy.

7. Wallet, Payments & Premium

7.1 Wallet Recharge

Wallet can be recharged via supported methods (UPI, cards, net banking in India; Stripe internationally where available). Top-ups are credited instantly after payment confirmation.

7.2 Paid Messaging & Tips

  • Tips and paid messages are voluntary and non-refundable, supporting creator economy.
  • Creator earnings: 80% creator, 20% platform fee for infrastructure, fraud prevention, and support.
  • Payouts: Minimum $10 or ₹800 equivalent, processed 24-48 hours, KYC required above ₹50,000 or $600/month per regulatory norms.

7.3 Premium Features

Premium may include priority support, enhanced privacy controls, custom themes, and faster edge routing. Premium is opt-in, cancellable anytime, detailed at /payment-terms.

8. Advertisements

Funtoosh displays internal text-based promotional advertisements (e.g., Upgrade to Premium, Invite Friends, Creator Tools) via our own ad system, not Google Ads. Ads are clearly marked as Sponsored, non-intrusive, no popups, no autoplay. Future ads will be controlled via admin panel and comply with our Content Policy and Anti-Spam Policy.

9. Account Suspension & Termination

We may suspend, limit discovery, or terminate accounts that violate these Terms, Community Guidelines, Content Policy, Acceptable Use Policy, or Safety Policy. You may delete your account anytime via Settings → Danger Zone. Upon deletion, local keys are wiped immediately, public key queued for deletion within 7 days, wallet ledger retained in hashed form where required for fraud prevention up to 7 years.

10. Disclaimer

Platform is provided “as is” without warranties. We strive for 99.9% uptime but cannot guarantee uninterrupted service, especially during security updates. Anonymous messaging carries inherent risks; use blocking and reporting features for safety. Wallet is not a bank; Funtoosh is not a financial advisor.

11. Limitation of Liability

To the maximum extent permitted by law, Funtoosh liability is limited to amount you paid in last 12 months or ₹8,000 / $100 whichever higher. We are not liable for indirect, incidental, or consequential damages arising from anonymous interactions, wallet transactions, or advertisements.

12. Governing Law & Dispute Resolution

These Terms are governed by laws of India, with regard to conflict principles, and applicable international practices. Disputes first via [email protected], then via Grievance Redressal per IT Act, then binding arbitration in Kanpur, Uttar Pradesh, India, unless required otherwise by local consumer protection laws. 13. Changes to Terms

Material changes will be notified via in-app banner and posted at /terms with 30-day notice where required. Version history maintained. Continued use after effective date constitutes acceptance. Future-ready wording allows adding features like group anonymous chats, calls, and non-custodial wallet without rewriting core terms.

  • Comply with all policies, respect anonymity, use blocking/reporting responsibly
  • Keep account secure, do not share OTP, do not attempt fraud or spam

Platform Responsibilities

  • Provide secure anonymous messaging, Email OTP login, wallet, privacy protection, security monitoring, content moderation for reported content, fraud and abuse prevention
  • Maintain transparent policies and timely support

Statutory timelines we work to: acknowledgement within 24 hours; disposal within 15 days; prohibited content under Rule 3(2)(b) within 72 hours; non-consensual sexually explicit or morphed content under Rule 4(1)(p) within 24 hours; court or government orders under Rule 3(1)(d) within 36 hours. Removed content and the associated records are retained for 180 days for investigation purposes. These are the limits set by law for us to act within; they are not a guarantee of any particular outcome on any particular report.

Before we remove or disable content on our own initiative, Rule 4(8) requires us to notify you with reasons and give you a reasonable opportunity to dispute it. Automated tools may flag content, but a human reviews before any account-level action is taken. See the Transparency Report.

Your rights under the DPDP Act 2023

  • Notice and consent (§5): we tell you what we collect and why before you agree, and you can withdraw consent at any time in Settings.
  • Purpose limitation (§4, §6): your data is used only for running Funtoosh, safety, payments and legal obligations — never sold, never used to build advertising profiles.
  • Access and correction (§11): you can view and correct your profile data in Settings.
  • Erasure (§12): you can delete your account from Settings → Account. See Data Retention for what the law requires us to keep afterwards, and for how long.
  • Retention limit (§8(7)): we erase personal data once the purpose it was collected for is over, unless a law requires us to keep it.
  • Grievance redressal (§13): write to the officer named above, or use Grievance Redressal. Unsatisfied with the decision? Appeal to the Grievance Appellate Committee within 30 days. Data protection queries: [email protected].

Age: Funtoosh is for users aged 18 and over. Under the DPDP Act 2023 a person under 18 is a Child and we do not knowingly create accounts for them. No guarantees: Funtoosh is provided on an as-is basis. Nothing on this page is a guarantee of any specific result, earning, delivery time or moderation outcome.
