Copyright Policy
Respecting creators, intellectual property, and original content in anonymous messaging.
1. Content Ownership
You retain full ownership of messages, images, audio, and profile content you create and share on Funtoosh via anonymous messaging. We do not claim ownership. Your anonymous username does not affect IP ownership. User profiles, blocking, reporting, and wallet transactions do not transfer IP rights.
2. Definitions
- User Content: Messages, media, bios, and other material you create.
- Platform Content: Funtoosh branding, landing page design, advertisements, UI, and policy documents.
- Intellectual Property: Copyrights, trademarks, and related rights under Indian and international law.
3. License to Funtoosh
To operate anonymous messaging, Email OTP login, wallet, and advertisements, you grant Funtoosh a limited license:
- Scope: Non-exclusive, worldwide, royalty-free, to relay, display, and store encrypted content temporarily for delivery and for public profile display where you opt-in to discovery.
- Duration: Until you delete content or account; relay queue 24 hours then wiped per Data Retention & Deletion Policy.
- Limitation: The licence is limited to storing, relaying and displaying your content so the service can work. It does not transfer ownership.
4. Respecting Others' Intellectual Property
Do not share on Funtoosh:
- Copyrighted music, movies, books, software without permission or license.
- Photos, videos, or artworks you did not create and do not have rights to share.
- Trademarks, logos, or trade dress that cause confusion, except nominative fair use (e.g., mentioning brand for commentary).
- Content that violates Intellectual Property Policy and Content Policy.
5. Fair Use & Fair Dealing
Fair use for criticism, comment, education, or research may be permitted under applicable law (India fair dealing, US fair use), but do not rely on fair use for entire works. Short quotations with attribution are more likely to be considered fair. When in doubt, obtain permission.
6. DMCA Notice & Takedown (US) and IT Act (India)
If you believe content on Funtoosh infringes your copyright, send notice to [email protected] with:
- Your contact information (name, email, address, phone) — you may use attorney contact to preserve anonymity where allowed.
- Description of copyrighted work and proof of ownership.
- Location of infringing content: username (pseudonymous), message ID if available, timestamp, URL where applicable.
- Statement under penalty of perjury that you have good faith belief that use is not authorized by owner, agent, or law.
- Physical or electronic signature.
We review within 3 business days and remove or restrict access if valid, per Content moderation and Transparency commitments.
7. Counter-Notice
If your content was removed and you believe removal was mistake or fair use, send counter-notice to [email protected] with:
- Identification of removed content and location.
- Statement under penalty of perjury that removal was mistake or misidentification.
- Your contact information and consent to jurisdiction of courts in Kanpur, Uttar Pradesh, India, or your local jurisdiction where required.
- Signature.
We will forward counter-notice to complainant and restore content in 10–14 business days unless they file legal action, per Intellectual Property Policy.
8. Repeat Infringers
We maintain a repeat infringer policy per Terms of Service. Repeat copyright violations result in account suspension or termination per Account Suspension & Termination Policy. We may log hashes (not content) of removed material to prevent re-upload, preserving privacy with hashing, not content storage, consistent with privacy protection and security monitoring.
9. User Responsibilities
- Only share content you own or have permission to share.
- Respect Funtoosh branding and do not copy landing page design, advertisements, or policy text without permission.
- Use reporting users feature for IP violations, not public shaming.
- Understand blocking users prevents further IP misuse by that user toward you.
10. Platform Responsibilities
- Provide clear Copyright Policy, Intellectual Property Policy, and DMCA process, and respond to valid notices within stated timelines.
- Maintain content moderation for reported IP violations, transparency via Transparency Page, and protection against false claims.
- Educate users via Trust & Safety about IP respect in anonymous messaging.

Statutory timelines we work to: acknowledgement within 24 hours; disposal within 15 days; prohibited content under Rule 3(2)(b) within 72 hours; non-consensual sexually explicit or morphed content under Rule 4(1)(p) within 24 hours; court or government orders under Rule 3(1)(d) within 36 hours. Removed content and the associated records are retained for 180 days for investigation purposes. These are the limits set by law for us to act within; they are not a guarantee of any particular outcome on any particular report.
Before we remove or disable content on our own initiative, Rule 4(8) requires us to notify you with reasons and give you a reasonable opportunity to dispute it. Automated tools may flag content, but a human reviews before any account-level action is taken. See the Transparency Report.
Your rights under the DPDP Act 2023
- Notice and consent (§5): we tell you what we collect and why before you agree, and you can withdraw consent at any time in Settings.
- Purpose limitation (§4, §6): your data is used only for running Funtoosh, safety, payments and legal obligations — never sold, never used to build advertising profiles.
- Access and correction (§11): you can view and correct your profile data in Settings.
- Erasure (§12): you can delete your account from Settings → Account. See Data Retention for what the law requires us to keep afterwards, and for how long.
- Retention limit (§8(7)): we erase personal data once the purpose it was collected for is over, unless a law requires us to keep it.
- Grievance redressal (§13): write to the officer named above, or use Grievance Redressal. Unsatisfied with the decision? Appeal to the Grievance Appellate Committee within 30 days. Data protection queries: [email protected].
Age: Funtoosh is for users aged 18 and over. Under the DPDP Act 2023 a person under 18 is a Child and we do not knowingly create accounts for them. No guarantees: Funtoosh is provided on an as-is basis. Nothing on this page is a guarantee of any specific result, earning, delivery time or moderation outcome.
